For what purpose do we process your personal data?

At onLygal Seguros we process the information that your insurance company communicates to us, as well as that provided to us by the insured in the event of an accident in order to:

1. Comply with the reinsurance contract entered into with your insurance company, with the purpose of assuming all or part of the cost that it would have to face in the event of an accident.
2. Comply with the following legal obligations related to reinsurance activity:
   
   • Calculate the price of the reinsurance premium, through actuarial and statistical techniques.
   • Communicate information to the parent company of the Group to which onLygal Seguros belongs, for compliance with legal supervision obligations.
   • When appropriate, communicate to reinsurance entities the data strictly necessary to enter into a reinsurance contract or carry out related operations.
   • Prevent, deter, identify, detect, report and remedy fraudulent conduct related to insurance.
   • Prevent money laundering and terrorist financing.
   • Resolve complaints that, if applicable, are presented to Customer Service.
3. Following instructions from your insurance company, provide you with services related to the management of the claim. In this case, the person responsible for processing your data is your insurance company. Please consult the privacy policy included in your insurance contract for this purpose.

The personal data provided will be kept as long as the reinsurance contract concluded between onLygal Seguros and its insurance company is in force and, in any case, until the last of the declared claims ends. After two years from the date of cancellation of the reinsurance contract or the date of cancellation of the claim (whichever occurs later), onLygal Seguros will block your personal data in order to prevent its processing, except for making it available to Public Administrations. and Courts in order to comply with legal obligations. Once the blocking period has elapsed, it will be deleted.

What is the legitimacy for the processing of your data?

The legal basis for processing your data is as indicated below, correlatively to the purposes indicated above:

1. Your insurance company is entitled to enter into a reinsurance contract under the terms provided in thearticle 77 of Law 50/1980, of October 8, on Insurance Contracts. Correlatively, onLygal Seguros is entitled to comply with the contractual obligations assumed in the reinsurance contract entered into with its insurer.
2. onLygal Seguros is authorized to carry out certain treatments to comply with the following legal obligations:
• The processing of data for the purpose of assessing the risk and determining the reinsurance premium is necessary so that onLygal Seguros can comply with the legal obligations imposed by theLaw 20/2015 on Regulation, Supervision and Solvency of insurance and reinsurance entities, (hereinafter, LOSSEAR) to base the price of insurance on technical bases and statistical information.
• The communication of information to the parent insurance company of the Group to which onLygal Seguros belongs is based on the legal obligation of onLygal Seguros to comply with the provisions of articles 99.3 and 136 of the LOSSEAR, which establish the legal obligation of insurers of exchange within the Group, all the information that is relevant for the purposes of the supervision that must be carried out by the General Directorate of Insurance and Pension Funds in a consolidated manner for the entire insurance Group.
• The processing to enter into reinsurance contracts is necessary for the insurer to comply with its legal obligations and, in particular, to achieve an adequate technical-financial balance for the entity. This legal authorization is included in article 99.4 of LOSSEAR.
• Treatment to prevent fraud is necessary for the insurer to comply with the legal obligations established in article 100 of LOSSEAR, as well as to satisfy the legitimate interests pursued by the insurer (the group of clients and the general public). have a legitimate interest in ensuring that fraudulent activities are discouraged and detected when they occur).
• Treatment for the prevention of money laundering and terrorist financing is necessary so that the insurer can comply with the legal obligations established in Law 10/2010, of April 28, on the prevention of money laundering and the financing of terrorism.
• The processing to manage and resolve complaints in the Customer Service derives from compliance with the legal obligations established in Order ECO/734/2004, of March 11, on customer service departments and services and the customer ombudsman of financial entities
3. To know the legitimacy for the provision of services related to the management of the incident. Please consult the privacy policy included in your insurance contract for this purpose.

To which recipients will your data be communicated?

The personal data obtained during the management of the accident may be communicated to your insurance company, in order to know the accident rate and control, for your benefit, the service provided by onLygal Seguros.

The data will be communicated to the parent company of the Group to which onLygal Seguros belongs for compliance with legal supervision obligations.

In compliance with its legal obligations, onLygal Seguros may communicate the data to competent public bodies or authorities, such as the Spanish Tax Administration Agency (AEAT) and Courts and Tribunals.

onLygal Seguros uses some tools to manage communications with its clients (CRM) or the normal functioning of its services, such as email, with Microsoft, a company certified under the so-called EU-US Data Privacy Framework, as provided in the link.

No data will be transferred to other third parties, except under legal obligation.

Where does your data come from?

The personal data we process comes from your insurance company.

Your insurance company will not communicate specially protected data to us.

What are your rights when you provide us with your data?

Anyone has the right to obtain information about whether at onLygal Seguros we are processing their personal data:

• The user has the right to access their personal data, as well as to request the rectification of inaccurate data or, where appropriate, request its deletion strong>when, among other reasons, the data is no longer necessary for the purposes for which it was collected.
• In certain circumstances, the user may request the limitation of the processing of their data, in which case we will only keep them for the exercise or defense of claims.
• In certain circumstances and for reasons related to their particular situation, the user may object to the processing of their data. onLygal Seguros will stop processing the data, except for compelling legitimate reasons, or the exercise or defense of possible claims.
• The user will have the right to portability, that is, to have the personal data provided be transmitted directly to another person responsible in a structured, commonly used and machine-readable format, when technically possible.
